TrackDataLab Performance Systems LLC — End User License Agreement

Effective Date: August 15, 2026

1. Acceptance

By creating an account and using the TrackDataLab Coach Platform ("Platform"), you ("User") agree to be bound by this Agreement. If you do not agree, do not use the Platform. TrackDataLab Performance Systems LLC ("Company," "we," "us") may update this Agreement at any time. Continued use of the Platform after changes constitutes acceptance.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your own coaching and athletic performance management. You may not sublicense, resell, or share Platform access with any third party.

3. Your Responsibilities

You are responsible for keeping your login credentials secure and for all activity under your account. You are solely responsible for obtaining any necessary consents from athletes whose data you enter into the Platform, including consents required for minors. You agree to use the Platform only for lawful purposes and will not attempt to reverse-engineer, disrupt, or misuse it in any way.

4. Payments

Paid features require an active subscription. Fees are non-refundable except as required by law. We reserve the right to change pricing with reasonable advance notice. Failure to pay may result in suspension or termination of your account.

5. Intellectual Property & Data

The Platform and all related software, content, and designs are owned by or licensed to the Company. You retain ownership of data you enter. We may use anonymized, aggregated usage data to improve the Platform.

6. Disclaimer & Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THIS AGREEMENT SHALL NOT EXCEED THE FEES YOU PAID IN THE THREE (3) MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

7. Termination

Either party may terminate this Agreement at any time. We may suspend or terminate your account immediately for breach of this Agreement or non-payment. Upon termination, your right to use the Platform ends immediately. You may request a data export within 30 days of termination.

8. Governing Law

This Agreement is governed by applicable law. Any disputes will be resolved through binding arbitration on an individual basis; class actions are waived.
